Process Server Registration

PROCESS SERVER REGISTRATION INDIVIDUAL / CORPORATION / PARTNERSHIP

Business and Professions Code Section 22350 et al requires a Process Server to register in each county in which the Process Server performs acts for which registration is required.

Who is a Process Server? Business and Professions Code Section 22350 reads in part:

  • Individual – Any Person who makes more than 10 process services within this state during a calendar year.
  • Corporation / Individual – Any corporation or partnership that derives or expects to derive compensation from service of process within this state.

You should review all laws and regulations concerning Process Servers. If you are a Process Server or choose to become a Process Server in Ventura County, you must register with the County Clerk’s Office.

To complete the registration process, you must do the following:

PROCESS SERVER – INDIVIDUAL

  • Possess a valid, government issued, picture identification (established by a birth certificate, such as a Driver’s License or Passport).
  • The principal place of business or residential address must be located in the County of Ventura.
  • Present a bond in the amount of $2,000.00 naming the registrant as principal, providing the term of two (2) years, commencement date and expiration date.
  • Pursuant to Business and Profession Code §22350, the registrant will be required to submit a completed Live Scan application. A 90 day temporary identification card will be issued until live scan results from the Department of Justice have been reviewed and accepted. Thereafter, the permanent identification card will be issued. A Live Scan application may be obtained in person from the County Clerk’s Office.
  • Submit filing fees: $122.00 ($100.00 filing fee – B&P Code 22352, $7.00 file the bond – B&P Code 22353(c), $5.00 surety certificate fee – B&P Code 22353(a) and $10.00 identification card fee – B&P Code 22352(c)). A $49.00 fee will apply if not paid to Live Scan Operator at the time of the Live Scan. Additional, lost or stolen replacement cards are $10.00 each.

PROCESS SERVER – CORPORATION / PARTNERSHIP

NOTE: Employees are not covered under a corporation/partnership registration. Corporate officers or general partners who will be serving process must also file and post bond as “Individual.”

The registrants must appear in person and meet the following requirements:

  • Corporate officers or general partners must possess a valid, government issued, picture identification (established by a birth certificate, such as a Driver’s License or Passport).
  • The principal place of business must be located in the County of Ventura.
  • Present a bond in the amount of $2,000.00 naming the registrant as principal, providing the term of two (2) years, commencement date and expiration date.
  • Pursuant to Business and Profession Code §22351(b)(3), corporation or partnership has been organized and existing continuously for one year immediately preceding the filing, or a responsible managing employee, partner, or officer has previously been registered as a process server.
  • Pursuant to Business and Profession Code §22351.5 , all corporate officers or general partners will be  required to submit a completed Live Scan application. A 90 day temporary identification card will be issued until live scan results from the Department of Justice have been reviewed and accepted. Thereafter, the permanent identification card will be issued. Live Scan application may be obtained in person from the County Clerk’s Office.
